These terms govern your use of vernellsmith.shop and purchases from Vernell Smith, 9347 S Marquette, Chicago, Illinois 60617, United States. By browsing or placing an order, you agree to these terms, our Refund & Returns Policy, Shipping Policy, and Privacy Policy.
The store
We sell physical apparel, mainly t-shirts, to customers in the United States. We do not ship outside the United States.
Orders
A product page is an invitation to order, not a binding offer. We accept your order when we send a confirmation email. We may decline or cancel an order if an item is unavailable, if we suspect fraud, or if pricing or product information was posted in error. If we cancel, we refund the full amount paid.
You agree to provide a current email address and a complete US shipping address. You are responsible for charges that result from an address you entered incorrectly.
Prices and payment
Prices shown on the site do not include shipping unless stated. Shipping is calculated at checkout under our Shipping Policy. Sales tax is added when US law requires it for your ship-to address, and it is shown before you pay.
Card payments are processed by Stripe Payments Company and its bank partners. We do not store your full card number or card security code. Other methods shown at checkout (if any) are billed as described on that screen. You authorize us and Stripe to charge the payment method you provide for the order total, including shipping and any required tax.
Shipping, returns, and cancellations
Delivery timing and cost are described in the Shipping Policy. Returns, refunds, and cancellations are described in the Refund & Returns Policy. You can cancel for a full refund before the order ships by emailing [email protected] with your order number.
Products
We try to show colors and fit accurately. Screens vary, so a small difference in color is not a defect. Apparel is sold for personal use, not for resale, unless we agree in writing.
Acceptable use
You may not misuse the site, attempt to break into it, scrape it in a way that degrades service, or use it for fraud.
Intellectual property
Site text, graphics, and product designs are owned by Vernell Smith or our licensors. You may not copy them for commercial use without written permission.
Disclaimer and liability
The site is provided as available. To the fullest extent allowed by US law, we are not liable for indirect, incidental, or consequential damages, or for lost profits, arising from your use of the site or a product. Our total liability for a claim about an order is limited to the amount you paid for that order. Some states do not allow certain limitations; in those states, our liability is limited to the maximum extent the law allows. Nothing in these terms limits liability for fraud or for injury caused by a defective product where the law forbids that limit.
Disputes
These terms are governed by the laws of the State of Illinois and the United States, without regard to conflict-of-law rules. Before filing a claim, email [email protected] so we can try to resolve it. Courts in Cook County, Illinois, are the exclusive venue for disputes that we cannot resolve, except that either party may bring an eligible claim in small-claims court.
